NEW DELHI: Chief Justice S A Bobde on Tuesday said that the nine-judge constitution bench will hear and complete arguments in 10 days on the larger issue of faith versus fundamental rights arising from the controversy over womens entry into Sabarimala temple, mosques and Parsi agiyaris.
“It cannot be given more than 10 days for completion of arguments.Even if someone wants more time, it cannot be given,” the CJI told solicitor general Tushar Mehta when the latter informed that counsel for various parties, who met on court orders, could not arrive at an agreement over framing common questions of law to be addressed before the nine-judge bench.
CJI Bobde asked the SG to hand over questions framed by lawyers for various parties and said, “We will frame the common questions of law.” For this, a three-judge bench will have to hear lawyers and determine which questions should be retained and what should be deleted.
On January 13, the nine-judge bench of Justices Bobde, R Banumathi, Ashok Bhushan, L Nageswara Rao, M M Shantanagoudar, S Abdul Nazeer, R Subhash Reddy, B R Gavai and Surya Kant had said it would decide the larger issue and would not hear arguments on petitions specifically seeking review of the SCs September 28, 2018 judgment quashing the ban on entry of women in the 10-50 year age group into Sabarimala Ayyappa temple.
