An effort to prosecute Boris Johnson over his claim that the U.K. pays £350 million per week to the EU was thrown out by a London court today.
Two High Court judges took just five minutes to quash a decision by a lower court to allow the case to proceed to criminal trial, the Evening Standard reported.
The former foreign secretary was accused of misconduct in public office.
The NHS cash claim — which is false — was plastered all over a campaign bus that toured Britain in the run-up to the Brexit referendum in 2016, promising to spend that money on the U.K.s National Health Service instead of on EU membership.
Businessman Marcus Ball brought a private prosecution against Johnson after raising more than £200,000 in a crowdfunding campaign to finance legal action over the claim.
A lawyer representing Johnson told the court last month that Balls application is a “political stunt” and that the businessman wants to “undermine the referendum result.”
